Please read these Terms of Service ("Terms") carefully before using the services offered by Nxt Page LLC ("Nxt Page," "we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms.

1. Services

Nxt Page provides digital marketing services including automated Google review request campaigns, reputation management, AI-powered review response drafting, and related reporting services (collectively, the "Services"). The specific features available to you depend on the service plan you select.

2. Eligibility

You must be at least 18 years of age and a legal business entity or sole proprietor to use our Services. By agreeing to these Terms, you represent that you meet these requirements and have the authority to enter into this agreement on behalf of your business.

3. Account and Onboarding

To use our Services, you will provide us with your business information and customer contact data. You represent and warrant that:

• You have the legal right to provide customer contact information to us
• Your customers have consented to receive SMS and/or email communications from your business
• All information you provide is accurate and up to date
• You will notify us promptly of any changes to your information

4. Acceptable Use

You agree not to use our Services to:

• Send messages to individuals who have not consented to receive communications from your business
• Violate any applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or carrier regulations
• Engage in any form of spam, harassment, or deceptive communication
• Attempt to manipulate or falsify reviews in violation of Google's policies
• Upload contact lists obtained from third-party sources, purchased lists, or scraped data

5. Fees and Payment

Our Services are offered on a monthly subscription basis. Fees are charged at the beginning of each billing period. All fees are in USD. By providing payment information, you authorize us to charge your payment method on a recurring monthly basis.

We reserve the right to modify pricing with 30 days' written notice. Continued use of the Services after a price change constitutes acceptance of the new pricing.

6. Free Trial

New customers may be eligible for a 10-day free trial. At the end of the trial period, your payment method will be charged unless you cancel before the trial ends. You may cancel your trial at any time before it expires with no charge.

7. Money-Back Guarantee

We offer a 30-day money-back guarantee for new subscribers. If you are not satisfied with our Services within the first 30 days of a paid subscription, contact us at brandon@nxtpage.ai for a full refund. Refund requests must be submitted within 30 days of your first payment.

8. Cancellation

You may cancel your subscription at any time by contacting us at brandon@nxtpage.ai or by calling 208-991-6514. Cancellations take effect at the end of the current billing period. We do not provide prorated refunds for mid-cycle cancellations except as covered by the 30-day money-back guarantee.

9. SMS Compliance

By providing customer contact data to us for SMS campaigns, you represent that those customers have opted in to receive text messages from your business and that your opt-in practices comply with the TCPA and all applicable regulations. You agree to indemnify and hold harmless Nxt Page for any claims arising from your failure to obtain proper consent.

All SMS messages sent through our platform include opt-out instructions. We honor all opt-out requests immediately.

10. Intellectual Property

All content, branding, and materials on nxtpage.ai are owned by Nxt Page LLC and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

11. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee any specific number of reviews, star rating improvements, or business outcomes. Results vary based on factors outside our control including customer response rates and Google's platform policies.

12. Limitation of Liability

To the fullest extent permitted by law, Nxt Page LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability to you shall not exceed the amount paid by you to us in the three months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Nxt Page LLC, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Services, your violation of these Terms, or your violation of any applicable law or third-party rights.

14. Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Idaho.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or by posting the updated Terms on this page. Continued use of our Services after changes constitutes acceptance of the updated Terms.
